Users may access the Service 24 hours per day, 7 days per week, 365 days per year (subject to the limitations, exceptions, force majeure events, scheduled maintenance periods, unscheduled maintenance periods, emergency maintenance periods, infrastructure failures, upstream provider outages, DNS propagation delays, certificate expiration events, rate limiting incidents, abuse mitigation responses, legal compliance requirements, and/or any other interruption, suspension, termination, degradation, or unavailability of the Service as more fully described in the Terms of Service) through our web-based audio player interface (the 'Web Player'), through our Discord Bot application (the 'Bot'), through embedded players on third-party websites (the 'Embeds'), through application programming interfaces (the 'APIs'), and/or through any other means of access now existing or hereafter developed. The Service was initiated, created, developed, deployed, operated, and maintained as a personal passion project, community-oriented initiative, hobbyist endeavor, non-commercial enterprise, and/or labor of love (hereinafter collectively referred to as a 'Side Project'). THE OPERATORS MAKE NO REPRESENTATION, WARRANTY, GUARANTEE, PROMISE, COMMITMENT, COVENANT, UNDERTAKING, OR BINDING OBLIGATION REGARDING THE FUTURE COMMERCIAL STATUS OF THE SERVICE. Support, bug reports, feature requests, and all other forms of communication regarding the Service may be submitted through the official erlc.fm Discord server (the 'Discord Server') by opening a support ticket in the designated ticketing channel (the 'Ticket System'). Users may access the Discord Server via the link provided on the Official Domain or through the Discord Bot's /discord command. THE OPERATORS MAKE NO REPRESENTATION, WARRANTY, GUARANTEE, PROMISE, COMMITMENT, COVENANT, UNDERTAKING, OR BINDING OBLIGATION REGARDING: (a) the response time to any support ticket, bug report, feature request, or other communication; (b) the resolution of any issue reported through the Ticket System; (c) the implementation of any feature requested; (d) the acknowledgment, confirmation, verification, or reproduction of any bug reported; (e) the provision of a workaround, patch, fix, update, or other resolution for any reported issue; (f) the availability, responsiveness, competence, knowledge, or helpfulness of any support staff, volunteer, moderator, administrator, developer, or other person who may or may not respond to your communication; or (g) the confidentiality, privacy, security, or protection of any information you submit through the Ticket System or any other communication channel. The Bot operates using Discord's Application Programming Interface (API) and requires certain permissions and intents to function as designed. The Operators are currently exploring, researching, prototyping, developing, testing, and/or evaluating the feasibility of implementing Discord Voice Activity (also known as Discord Activities, Discord Voice Channel Activities, or Discord Embedded App SDK) support for the Service (the 'Activity Feature'). If and when implemented, the Activity Feature would permit users to listen to the Service's audio stream in synchronization with other users within the same Discord voice channel, accessible through the 'Start an Activity' button (colloquially referred to as the 'Rocket Ship Icon') within a Discord voice channel. THE OPERATORS MAKE NO REPRESENTATION, WARRANTY, GUARANTEE, PROMISE, COMMITMENT, COVENANT, UNDERTAKING, OR BINDING OBLIGATION THAT THE ACTIVITY FEATURE WILL EVER BE DEVELOPED, RELEASED, DEPLOYED, MADE AVAILABLE, OR OTHERWISE IMPLEMENTED. Users participating in the erlc.fm Discord Server (the 'Server') are expected to comply with: (a) Discord's Terms of Service and Community Guidelines; (b) the Server-specific rules, which are posted in the designated rules channel and may be updated from time to time; (c) the Service's Terms of Service, Privacy Policy, and other legal policies; and (d) any reasonable instructions, directions, or requests from Server moderators, administrators, or the Operators. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE FOLLOWING ACTIVITIES ARE STRICTLY PROHIBITED IN THE SERVER: (i) harassment, bullying, intimidation, threats, doxxing, stalking, or any other form of abusive, hostile, or menacing conduct; (ii) hate speech, discriminatory language, slurs, or other content that attacks, demeans, or marginalizes individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or any other protected characteristic; (iii) spamming, flooding, message bombing, or otherwise disrupting chat channels; (iv) sharing, linking to, or soliciting sexually explicit, pornographic, or otherwise NSFW content; (v) sharing, linking to, or soliciting content that promotes violence, self-harm, suicide, or illegal activities; (vi) impersonating Server staff, the Operators, or any other individual or entity; (vii) engaging in phishing, scamming, social engineering, or other deceptive, fraudulent, or malicious activities; (viii) advertising, promoting, or soliciting for other Discord servers, websites, services, products, or communities without explicit permission from the Operators; (ix) using automated scripts, self-bots, user-bots, or other automated tools to interact with the Server; (x) attempting to exploit, manipulate, or abuse Server features, roles, permissions, or infrastructure; or (xi) any other conduct that the Operators, in their sole and absolute discretion, deem inappropriate, disruptive, harmful, or incompatible with the Server's community atmosphere. VIOLATIONS OF SERVER RULES MAY RESULT IN WARNINGS, MUTES, TEMPORARY TIME-OUTS, KICKS, BANS, OR ANY OTHER MODERATION ACTION THAT THE OPERATORS OR SERVER STAFF DEEM APPROPRIATE, IN THEIR SOLE AND ABSOLUTE DISCRETION, WITH OR WITHOUT WARNING, NOTICE, OR EXPLANATION.

THE OPERATORS DO NOT AND CANNOT PROVIDE LEGAL ADVICE, COPYRIGHT ADVICE, LICENSING ADVICE, OR ANY OTHER FORM OF LEGAL GUIDANCE OR RECOMMENDATION REGARDING THE USE OF AUDIO CONTENT FROM THE SERVICE IN LIVE STREAMS, RECORDED VIDEOS, VIDEO-ON-DEMAND CONTENT, CLIPS, HIGHLIGHTS, MONTAGES, COMPILATIONS, REACTIONS, COMMENTARIES, CRITIQUES, REVIEWS, ANALYSES, PARODIES, SATIRES, REMIXES, MASHUPS, SAMPLES, OR ANY OTHER FORM OF USER-GENERATED CONTENT (COLLECTIVELY, 'STREAMER CONTENT'). The Operators endeavor to curate a selection of music tracks that are, to the best of their knowledge and based on available metadata and third-party licensing information, stream-friendly and unlikely to trigger automated copyright detection systems. HOWEVER, BECAUSE THE SERVICE UTILIZES AN AUTOMATED, ALGORITHMIC, AI-ASSISTED, AND USER-REQUEST-RESPONSIVE MUSIC SELECTION AND PLAYBACK SYSTEM (THE 'AUTODJ'), AND BECAUSE THE SERVICE ACCEPTS AND PROCESSES USER-SUBMITTED SONG REQUESTS THAT MAY INCLUDE TRACKS WHOSE COPYRIGHT STATUS, LICENSING ARRANGEMENTS, RIGHTS CLEARANCES, OR PERMITTED USE CASES ARE UNKNOWN, UNCERTAIN, DISPUTED, OR RESTRICTED, THERE IS A NON-ZERO PROBABILITY THAT ANY PARTICULAR TRACK PLAYED THROUGH THE SERVICE MAY: (a) be subject to copyright protection; (b) be subject to an active copyright claim; (c) be subject to a Content ID claim on YouTube; (d) be subject to a music matching claim on Twitch; (e) be subject to a takedown notice under the Digital Millennium Copyright Act (DMCA) or equivalent legislation in any jurisdiction; (f) trigger audio muting, video blocking, demonetization, content ID claim, copyright strike, or other adverse action on any streaming or video-sharing platform; (g) result in a suspension, termination, or restriction of your account on any streaming or video-sharing platform; (h) expose you to legal liability, including but not limited to statutory damages for copyright infringement; or (i) have any other negative, adverse, detrimental, harmful, or undesirable consequence for your streaming or content creation activities. YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ASSESSING THE RISK OF COPYRIGHT INFRINGEMENT, SECURING ANY NECESSARY LICENSES, PERMISSIONS, OR CLEARANCES, AND COMPLYING WITH ALL APPLICABLE LAWS, REGULATIONS, PLATFORM POLICIES, AND RIGHTS HOLDER REQUIREMENTS IN CONNECTION WITH YOUR CREATION AND DISTRIBUTION OF STREAMER CONTENT. The Service is designed, curated, programmed, configured, and intended for a PG-13 (Parental Guidance Suggested for children under 13) audience, consistent with and mirroring the older player demographic typically associated with the Roblox platform. The AutoDJ system incorporates automated content filtering mechanisms (the 'Content Filters') designed to detect, flag, and exclude audio content containing extreme profanity, explicit language, hate speech, graphic violence, sexually explicit material, or other content that the Operators, in their sole and absolute discretion, deem inappropriate for the Service. THE CONTENT FILTERS ARE NOT PERFECT, ARE NOT COMPREHENSIVE, ARE NOT FOOLPROOF, ARE NOT ERROR-FREE, AND MAY FAIL TO DETECT, FLAG, OR EXCLUDE CONTENT THAT VIOLATES THE SERVICE'S CONTENT STANDARDS. FURTHERMORE, THE CONTENT FILTERS MAY INCORRECTLY FLAG AND EXCLUDE CONTENT THAT DOES NOT VIOLATE THE SERVICE'S CONTENT STANDARDS (FALSE POSITIVES) OR INCORRECTLY ALLOW CONTENT THAT DOES VIOLATE THE SERVICE'S CONTENT STANDARDS (FALSE NEGATIVES). THE OPERATORS MAKE NO REPRESENTATION OR WARRANTY THAT THE SERVICE IS SAFE, SUITABLE, APPROPRIATE, OR PERMISSIBLE FOR CHILDREN UNDER THE AGE OF 13, OR FOR ANY PERSON WHO MAY BE SENSITIVE TO, OFFENDED BY, DISTRESSED BY, OR OTHERWISE ADVERSELY AFFECTED BY CONTENT CONTAINING MILD LANGUAGE, SUGGESTIVE REFERENCES, ADULT THEMES, OR OTHER MATERIAL THAT MAY NOT BE SUITABLE FOR ALL AUDIENCES. If you encounter audio content through the Service that you believe violates the Service's content standards, you are encouraged (but not obligated) to report such content through the Discord Server's ticketing system or through any other reporting mechanism that the Operators may provide. The Operators reserve the right, in their sole and absolute discretion, to investigate, act upon, or decline to act upon any such report, and to remove, block, exclude, or restrict any content from the Service without notice, explanation, or justification.

Users may submit song requests through the Service's Request page, accessible at the /r path on the Official Domain (the 'Request Page'), or through the Bot using available command interfaces (the 'Request Features'). All song requests submitted through the Request Features are subject to review, evaluation, assessment, and processing through both automated systems (including but not limited to metadata analysis, content filtering, copyright screening, duplication detection, and format validation) and, in certain cases, manual review by the Operators or their designated representatives. THE OPERATORS MAKE NO REPRESENTATION, WARRANTY, GUARANTEE, PROMISE, COMMITMENT, COVENANT, UNDERTAKING, OR BINDING OBLIGATION THAT ANY SONG REQUEST SUBMITTED THROUGH THE REQUEST FEATURES WILL BE: (a) received, processed, acknowledged, or reviewed within any particular time frame; (b) approved, accepted, queued, scheduled, or played at any time; (c) played in its entirety without interruption, truncation, skipping, fading out, or other alteration; (d) exempt from content filtering, copyright screening, or other review processes; (e) kept confidential, private, or anonymous; (f) associated with your username, Discord identity, or any other identifier in any particular manner; or (g) treated preferentially, equally, or in any other manner relative to other song requests. Users acknowledge and agree that the AutoDJ system, in its sole and absolute discretion, may: (i) skip, remove, re-queue, reschedule, or otherwise alter the playback order of any requested song; (ii) decline to play any requested song for any reason or no reason; (iii) play a different version, recording, mix, remix, cover, or alternate rendition of a requested song than the version submitted; (iv) play a requested song at a different time, in a different context, or under different circumstances than anticipated; or (v) fail to play a requested song due to technical limitations, data unavailability, licensing restrictions, geographic restrictions, or any other reason. All song requests must comply with the Service's content standards, the Terms of Service, the Discord Community Guidelines (if applicable), and all applicable laws and regulations. The Operators reserve the right to reject, remove, block, or otherwise decline to process any song request that, in their sole and absolute discretion, violates any of the foregoing standards, guidelines, terms, laws, or regulations.

erlc.fm is a non-commercial community radio station that streams music from a variety of sources. The Operators do not claim ownership, title, interest, copyright, or any other proprietary right in or to the audio content transmitted through the Service, unless explicitly stated otherwise. THE OPERATORS MAKE NO REPRESENTATION, WARRANTY, GUARANTEE, PROMISE, COMMITMENT, COVENANT, UNDERTAKING, OR BINDING OBLIGATION THAT: (a) any particular audio track transmitted through the Service is properly licensed, cleared, authorized, or permitted for public performance, digital transmission, streaming, broadcast, or any other form of communication to the public in your jurisdiction; (b) the Operators have obtained, secured, or maintained any public performance license, mechanical license, synchronization license, master use license, digital performance license, statutory license, compulsory license, blanket license, or any other form of copyright license or authorization from any rights holder, collective rights management organization, performing rights organization (PRO), mechanical rights organization, sound recording copyright owner, musical composition copyright owner, publisher, record label, distributor, or other rights holder; (c) the Service is compliant with the requirements of any particular copyright law, licensing scheme, royalty framework, or regulatory regime in any jurisdiction; (d) any royalties, fees, payments, or other compensation have been or will be paid to any rights holder in connection with the transmission of audio content through the Service; or (e) the Service's use of any audio content constitutes fair use, fair dealing, or any other exception or limitation to copyright or related rights under the laws of any jurisdiction. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT YOU BEAR ALL RISK ASSOCIATED WITH THE COPYRIGHT STATUS, LICENSING STATUS, AND LEGALITY OF THE AUDIO CONTENT TRANSMITTED THROUGH THE SERVICE, AND YOU HEREBY RELEASE, INDEMNIFY, DEFEND, AND HOLD HARMLESS THE OPERATORS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES AND LEGAL COSTS) ARISING FROM OR RELATED TO ANY ALLEGED OR ACTUAL INFRINGEMENT OF COPYRIGHT OR RELATED RIGHTS IN CONNECTION WITH YOUR USE OF THE SERVICE.

THE CONSEQUENCES FOR VIOLATIONS MAY INCLUDE, IN THE OPERATORS' SOLE AND ABSOLUTE DISCRETION, ANY ONE OR MORE OF THE FOLLOWING: (i) a verbal or written warning; (ii) temporary suspension of access to the Service, the Bot, or the Discord Server; (iii) permanent termination of access to the Service, the Bot, or the Discord Server; (iv) blocking of your IP address, IP address range, Discord user ID, or other identifier; (v) removal, deletion, or modification of any content you have submitted, posted, or transmitted through the Service; (vi) forfeiture of any song requests, queue positions, or other accrued benefits or status; (vii) reporting of your conduct to Discord Trust & Safety, Roblox moderation, law enforcement authorities, or other relevant entities; (viii) legal action seeking damages, injunctive relief, or other remedies; and/or (ix) any other consequence or remedial measure that the Operators deem appropriate under the circumstances. THE OPERATORS ARE UNDER NO OBLIGATION TO PROVIDE WARNING, NOTICE, EXPLANATION, OR JUSTIFICATION PRIOR TO TAKING ANY ENFORCEMENT ACTION, AND MAY TAKE SUCH ACTION RETROACTIVELY, PROSPECTIVELY, OR IN ANY OTHER TEMPORAL ORIENTATION.

THIS PROHIBITION APPLIES REGARDLESS OF WHETHER: (a) the Commercial Space charges admission, entry fees, cover charges, or any other form of payment for access; (b) the Service is played through a personal device, a public sound system, a commercial audio system, a multi-room audio setup, or any other audio equipment; (c) the Service is audible to customers, clients, patients, patrons, guests, visitors, members, employees, staff, contractors, or any other persons present in the Commercial Space; (d) the use of the Service in the Commercial Space enhances the atmosphere, environment, experience, or enjoyment of persons present; (e) the Commercial Space is operated for profit or not-for-profit; or (f) you believe that your use falls within any exception, exemption, limitation, or defense under applicable copyright law. The use of the Service in Commercial Spaces may require separate public performance licenses from the relevant performing rights organizations (such as ASCAP, BMI, SESAC, SOCAN, PRS, GEMA, or equivalent organizations in your jurisdiction), and the Operators' provision of the Service does not grant, convey, imply, or authorize any such public performance rights.
